HIPAA And Obamacare

posted by gyma

Mr. gyma saw the dermatologist this week and he was asked to sign the "New and Improved" HIPAA release. I asked what had changed and the receptionist pooh-poohed my question.

I didn't have an issue with most of it, but this part stood out:

The practice may also be required or permitted to disclose your protected health information for law enforcement and other legitimate reasons. In all situations, we shall do our best to assure its continued confidentiality to the extent possible.

WTF?

I'm wondering what the definition is of "other legitimate reasons". Seems a bit vague, doesn't it? And I'm really feeling confident that my doctor(s) will be able to protect my confidential health information when they tack on the nebulous phrase, "to the extent possible".

Maybe the teabaggers who are screaming about Obamacase have a point. At least this part of it.

In reaction to the recent mass murders in CT and CO, HHS sent out a letter in January to clarify your newly eroded 4th and 5th amendment rights on the new HIPAA form. Please note that your amendment #2 rights have remained untouched. USA! USA!
